WARRANTYANDCLAIMS Warranty

ForequipmentandmaterialmanufacturedbytheSeller,theSellerwarrantssuchequipmentfora periodofone(1)yearfromdateofinstallationunder normaluseandserviceagainstimproper performancecausedbydefectivematerialsorworkmanship.Thiswarrantyiseffectiveforone(1)year regardlessofthenumberofhoursperdayofequipmentuse.

TheSellerwill,onrequestoftheBuyer,providetotheBuyeraserviceengineertorepairorreplace faultypartsormakenecessaryadjustmentsorcalibrations,providedthattheBuyerisunabletomake necessaryrepairswithpartsandinstructionsfurnishedbytheSellerandfurther,hasfollowedthe maintenanceandcheck-outinstructionsandproperlycompletedperiodicwarrantyinspectionsif detailedbythemachineoperatingmanual.TherewillbenochargetotheBuyerforpartsandlabor.The Buyerwillberesponsibleforpaymentofalltravelexpensesoftheserviceengineer,includingbutnot limitedtoairfare,localtransportation(taxis,trains,buses,etc.),hotels,parking,rentalcar,mileage,and food.

AnywarrantycostbornebyDACInternationalasaresultofimproperinstallationbytheuser(power notbeingwithinDACInternationalproductspecifications,orcausedbyotherinstallationfault)shallbe billablebyDACInternationaltotheuseratstandardfieldservicerates.

ExceptasexpresslywarrantedintheSalesOrder,theSellermakesnootherwarrantyofanykind, expressedorimplied,includinganywarrantycoveringordinarywearandtear,abuse,misuse, overloading,alterations,expendableparts,andpartscomingintocontactwithcorrosivechemicalsor damagecausedbycausesoutside oftheSeller'scontrol.

LimitationofSeller'sLiability

TheSeller'sliabilityunderanywarrantyshallbelimitedtorepairingorreplacingF.O.B.Buyer'splant, anypartorpartsofmaterialwhichmayprovetobethusdefectiveprovidedtheBuyergivesSeller promptnoticeofthedefect,andinspection,ifrequiredbytheSeller,confirmsthedefect.Thisremedy ofrepair,replacementorcredit,atSeller'soptionistheexclusiveremedythereunder.Sellershallhave nootherliabilitytoBuyeronany claimshoweverarisingandinnoeventshallSellerbeliableforspecial, incidentalorconsequentialdamages.

WarrantyExchangePolicy Duringthewarrantyperiod,DACInternationalwillreplaceanyfaultypartscoveredbythewarranty.

ThesepartswillbeconsignedtoBuyeratstandardlistpricewhenshipped.Onreceiptofthefaulty part, returnedprepaidtoDACInternational,fullcreditwillbeissued,providedthatthepartreturned hasfailedbecauseofwarrantablecause,andthatthepartisreturnedwithinthespecifiedperiod statedontheorder/packingslip.

Creditwillbeissuedasfollows:

  •             Partsreturnedwithin30dayswillreceive100% credit.
  •             Partsreturnedbetween31and40dayswillbeassesseda20%re-stocking fee.
  •             Partsreturnedbetween41and59dayswillbeassesseda50%re-stocking fee.
  •             NORETURNS willbeacceptedafter60days – NO EXCEPTIONS!

WarrantyTransportation

PleasenotethatDACInternationalwillmakeshipmentofthereplacementpartprepaidviaAirMail, UPS, orFed-X.Ifspecialpremiumairtransportationisrequested,thepartwillthenbefurnishedwithshipping chargescollect.

ClaimforShipmentDamage

Allequipmentshouldbetestedassoonasitisreceivedaccordingtotheinstructionsfurnished.Ifit failstooperateproperlyorisdamagedinanyway,aclaimshouldbefiledwiththecarrier.

Afullreportofthedamageshouldbemadetotheclaimagentandacopyofthisreportforwardedto DACInternational.Thecustomerwillthenbeadvisedof thedispositiontobemadeoftheequipmentand thearrangementsforitsrepairorreplacement.
